Planning Overview:
The Government advises that, ‘The planning system exists to regulate the development and use of land in the public interest’.
On the 31st March 2011 the Agency status of the Planning Service of Northern Ireland ended and from the 1st April 2011 it has been absorbed into the Department of the Environment. Furthermore from the 1st April 2011 the six Planning Divisions have been reorganised into five Planning Areas. These changes are part of the wider process to transfer planning powers back to the future 11 local councils.
Presently the primary planning legislation for Northern Ireland is ‘The Planning (Northern Ireland) Order 1991’. Under this Order the Department’s main functions are the preparation of planning policy and development plans, controlling development through planning permission and consent procedures and taking enforcement action against breaches of planning control. Notably amendments to the order were undertaken with the Planning (Amendment) (Northern Ireland) Order 2003 and the Planning Reform (Northern Ireland) Order 2006.
