The NI and ROI Quarries Regulations impose a general duty on the mineral operator to ensure the safety of excavations and tips – including stockpiles and lagoons.
The operator must ensure that a suitable appraisal is undertaken by a competent person in order to identify whether any excavation or tip is a significant hazard.
Where no significant hazard is identified, further appraisals must be carried out at appropriate intervals.
Where a significant hazard is identified, a geotechnical assessment must be carried out by, or under the supervision of, a Chartered Engineer or Chartered Geologist.
